Harcourts Quarterly Awards Terms and Conditions ​​​​

IMAGE & MEDIA RELEASE
By registering for the Harcourts Quarterly Awards ("Event"), Delegates:
-
Acknowledge and agree that photographs or audio/video recordings containing the image, voice, or likeness ("Recordings") of Delegates (including you) may be taken by Harcourts Group Limited or its Personnel (employees, agents, subcontractors, or volunteers).

Grant unconditional and irrevocable consent for Harcourts Group Limited and its Personnel to use these Recordings and any previously provided information ("Content") indefinitely and without restriction for promotional, news, multimedia, research, educational, or other relevant purposes.

Agree that Delegates are not entitled to remuneration or royalties for any Recordings or Content used.

Acknowledge Harcourts Group Limited as the sole legal and beneficial owner of intellectual property rights to the Recordings and consent irrevocably to the infringement of any moral rights Delegates may have in these Recordings.

Accept that Harcourts Group Limited may transfer the consent rights granted to third parties.

Release Harcourts Group Limited and its Personnel from any liability for expenses, claims, or damages arising from the Recordings or Content.

Delegates wishing not to be photographed or recorded must notify Harcourts in writing via eventsnz@harcourts.net. Opting out may affect participation in certain sessions or activities.
LIABILITY
Delegates acknowledge and agree attendance and participation are at their own risk. Delegates should obtain their own insurance covering travel, accommodation, health, personal property, injury, death, and all other risks. Delegates release and hold harmless Harcourts Group Limited and its Personnel from liability for losses related to Event participation, including travel.
Delegates acknowledge that Harcourts Group Limited (and/or its AV or production contractors) may employ theatrical haze, fog, strobe lighting, or similar special effects during the Event. Delegates accept risks associated with these effects. Harcourts Group Limited and its Personnel will not be liable for losses related to Delegate sensitivity or reactions to these effects. Delegates with respiratory or medical concerns are advised to consult healthcare professionals prior to attending.
Nothing herein excludes liability for personal injury/death caused by negligence, fraud, or where exclusion isn't legally permissible.
Delegates indemnify Harcourts Group Limited and its Personnel against losses arising from breaches of these terms, warranties, or negligence by Delegates.
COLLECTION AND USE OF INFORMATION
By registering, Delegates acknowledge that personal information provided or collected will be handled per Harcourts Group Limited's privacy policy (https://content.harcourts.co.nz/popup/privacypolicy). Information collected facilitates registration, Event administration, communication, and enhances Delegate experiences.
Information may be shared with Event sponsors, venues, accommodation providers, and relevant third-party providers for promotional and follow-up activities. Delegates may opt-out of third-party sharing by contacting eventsnz@harcourts.net.
SPECIAL DIETARY OR PHYSICAL REQUIREMENTS
Special dietary or physical requirements must be requested prior to the Event registration closing date. Please specify requirements on the registration form or via email to eventsnz@harcourts.net.
VENUE MANAGEMENT AND CONTROL
Harcourts Group Limited has the right to:

Refuse admission or remove Delegates from the venue for safety, security, or inappropriate behaviour.

Implement crowd control measures and safety procedures.

Suspend or cancel the Event to prevent danger or comply with authorities.
Delegates must comply with directions given by Harcourts or its representatives.
COMMERCIALLY SENSITIVE INFORMATION
Commercially sensitive information shared at the Event must remain confidential and not disclosed to unauthorised parties.
CANCELLATION OF EVENT BY HARCOURTS (FORCE MAJEURE)
In the unlikely occurrence of a Force Majeure Event, Harcourts reserves the right to alter, postpone, or cancel the Event:

Harcourts Group Limited, will at its discretion, refund any registration fees where the nature of the event is varied;

Delegates will receive a full refund if the event is cancelled; or
-
If the event is postponed, any registration fees will be automatically transferred to the rescheduled date.
CANCELLATION BY DELEGATE
Delegates wishing to cancel their event registration must submit their cancellation requests via email to eventsnz@harcourts.net no later than 5:00pm one week prior to the event to be effective. Upon successful cancellation, Delegates will be eligible for a refund of their event registration payments, subject to the following deductions:

System Booking Fees, Agents' Fees, and any Other Service Fees: A portion of the refund will be retained to cover any system booking fees, agents' fees, and other service fees incurred.

Costs Incurred by Harcourts Group Limited: Additionally, any costs incurred by Harcourts Group Limited in facilitating the refund will also be deducted from the refund amount.
RESPONSIBILITY
Harcourts Group Limited will use reasonable efforts to ensure that Delegates attendance at the event will be as comfortable and enjoyable as possible. Harcourts provides the event on the condition that Harcourts Group Limited, its employees, Delegates, agents and sub-contractors cannot be held liable for any loss, damage or inconvenience, however arising, experienced by Delegates at the event, including while travelling to or from the event venue, hotel and their office/home location.
GENERAL TERMS

Harcourts Group Limited may withdraw your right to participate in or otherwise cancel the event at any time in its absolute discretion and that any such decision by Harcourts Group Limited will be final and binding and no correspondence will be entered into in this regard. Should this occur, Harcourts Group Limited will provide delegate/s with a full refund of their event registration payments, and to the extent permitted by law, Harcourts Group Limited will not be liable to Delegates for any other Losses suffered.

If any provision or part of a provision of these terms and conditions can be read in a way that makes it illegal, unenforceable, or invalid, but can also be read in a way that makes it legal, enforceable, and valid, it must be read in the latter way.Harcourts may amend these terms without notice.

Should any provision of these terms and conditions be held to be unenforceable, such provision will be deemed severed from these terms and conditions without affecting the enforceability or validity of the remaining provisions which shall continue in full force and effect.

Harcourts Group Limited reserves the right to make amendments to these terms and conditions from time to time at its sole discretion and without notice.

These terms are governed by New Zealand law, and Delegates submit to the jurisdiction of New Zealand courts.​
